Sales Terms and Conditions

Definitions. For the purposes of the Sales Terms and Conditions, Return Policy and Warrantee the term Bike shall be used to reference any of the powered or non-powered vehicles we sell.

The term Purchaser shall be construed to mean any and all users or riders of the Bike even if they are not the original Purchaser, regardless of the original Purchaser's knowledge or consent to their use of the Bike.

The term Company shall be construed to mean Best in Green Solutions, LLC, it's affiliates, parent company and subsidiaries.

Assumption of Risk. Purchaser acknowledges that the activities for which the Bike is designed include inherent dangers, including the risk of bodily injury and/or death. Purchaser assumes and accepts all risks associated with the use of the Bike.

Release and Waiver of Claims. Purchaser does hereby remise, release, and forever discharge Company, Company’s agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, which Purchaser ever had, now has, or which Purchaser’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the Bike; or in any way arising out of the sales relationship between Purchaser and Company

Purchaser hereby waives the provisions of section 1542 of the California Civil Code, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Indemnification. Purchaser hereby expressly agrees to indemnify and hold harmless Company, Company’s agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Purchaser’s use, misuse or abuse of the Bike.


Satisfaction Guarantee/Return Policy

If you are not completely satisfied with your purchase, you may return the item to us within 30 days for a full refund subject to the following conditions:

1. You must contact us to obtain a Return Merchandise Authorization (RMA) prior to shipping the item back to us. We will give you the shipping information with the RMA.

2. You must return the item in like new condition for a full refund. If the item is not in like new condition we will refund a lesser amount at our sole discretion.

3. You must return the item in the original or equivalent packaging. Items damaged in transit due to improper packing will be subject to a lesser refund.

4. Items must be returned freight prepaid.

5. If the original purchase was made by credit card, the refund will be credited to that same credit card within 10 days of receiving the returned item. If the purchase was made by cash or check we will send you a check for the refund amount within 10 days of receiving the returned item.



Electric Bike and Scooter Warrantee

We provide the following warrantee on our electric bikes and scooters. Note that our warrantee is limited to manufacturing defect and expressly does not include flat tires, light bulbs, normal wear and tear or damages that arise out of Purchaser's use, misuse or abuse of the Bike.

Electric bikes and scooters - 6 months, all parts, no labor

All Batteries - 6 months

Accessories - 90 days, all parts, no labor
